CineCube: Color Match & 3D LUT

Terms of Use & End-User License Agreement (EULA) — CineCube: Color Match & 3D LUT

Effective Date: November 5, 2026Last Updated: November 5, 2026Developer / Licensor: Majid AlJishi

1. Acceptance of Terms & Incorporation of Apple Standard EULA

By downloading, installing, accessing, or using CineCube: Color Match & 3D LUT ("CineCube" or the "App"), you ("User" or "you") agree to be bound by these Terms of Use and End-User License Agreement ("Terms"). If you do not agree to every provision of these Terms, do not download, install, or use the App.

These Terms supplement and incorporate by reference the Apple Licensed Application End User License Agreement (Standard EULA). In the event of any conflict between the Apple Standard EULA and these Terms regarding developer liability, user-supplied media, intellectual property, or commercial production disclaimers, the more protective provisions in favor of the Developer in these Terms shall govern to the maximum extent permitted by Apple's App Store terms and applicable law.

2. Scope of License & Permitted Use

2.1 Grant of License

Subject to your compliance with these Terms and payment of any applicable In-App Purchase fees, Developer grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use CineCube on Apple-branded iOS, iPadOS, or macOS devices that you own or control, as permitted by the Apple Media Services Terms and Conditions.

2.2 Commercial & Creative Output Rights

You are expressly permitted to use the color-graded photos, 4K/ProRes/social media videos, cinema palette posters, and custom .CUBE 3D Look-Up Table ("LUT") files that you generate and export using CineCube for both personal and commercial projects (including client photography, commercial filmmaking, social media publishing, broadcast, and YouTube/Reels monetization), subject strictly to Section 3 below.

2.3 License Restrictions

You agree that you shall not, directly or indirectly:

  1. Reverse engineer, decompile, disassemble, decrypt, or attempt to derive the source code, proprietary color-matching equations, camera log transforms, or preset generation algorithms of CineCube;
  2. Modify, translate, adapt, rent, lease, loan, resell, distribute, or create derivative software applications based on the CineCube application or user interface;
  3. Bypass, tamper with, or circumvent purchase entitlement checks, the 2-export complimentary trial counter, or any security mechanism within the App;
  4. Use CineCube for any unlawful, defamatory, infringing, fraudulent, or harmful purpose in violation of any applicable local, national, or international law.

3. Intellectual Property, User Media & Copyright Responsibility

3.1 Ownership of Your Original Media & Exported .CUBE LUTs

Developer claims no ownership rights over the original photographs, videos, reference images, or external .CUBE files you import into CineCube, nor over the finished photos, videos, or custom .CUBE files you export from the App.

3.2 User Warranty Regarding Reference Images & Target Media (Copyright & Publicity Shield)

CineCube is a purely mathematical color-science tool that analyzes luminance and chrominance distributions from a user-selected Reference Image and applies those color parameters to Target Media or .CUBE lattices:

  • You are solely and exclusively responsible for all images, film stills, photographs, videos, audio tracks, and .CUBE files that you import, reference, grade, export, or distribute using CineCube.
  • You represent and warrant that you own or hold all necessary copyrights, licenses, model releases, property releases, and legal permissions required to load and process any Reference Image, Target Photo, or Target Video in CineCube.
  • Developer does not supply, host, license, or endorse any third-party copyrighted motion picture frames that a User may independently select from their own device library.

3.3 No Affiliation with Third-Party Brands, Cameras, or NLE Software

All references within CineCube and its documentation to third-party software, camera systems, color spaces, or hardware monitors—including but not limited to DaVinci Resolve®, Adobe Premiere Pro®, Adobe Lightroom®, Adobe Photoshop®, Adobe After Effects®, Apple Final Cut Pro®, Apple ProRes®, Apple Log, Capture One®, CapCut®, VN Video Editor, LumaFusion®, Sony® (S-Log3 / S-Gamut3.Cine), ARRI® (LogC3 / LogC4), Canon® (Canon Log 3), RED® (RED Log3G10 / RWG), Blackmagic Design® (BMD Film Gen 5), DJI® (D-Log), and Atomos®—are used strictly nominatively and descriptively to indicate technical interoperability with the open .CUBE 3D LUT file specification and standard camera log transfer curves. Such references do not imply any affiliation with, endorsement by, sponsorship by, or partnership with the respective trademark owners. All third-party trademarks are the property of their respective owners.

3.4 Developer's Proprietary Intellectual Property

The CineCube application name, logo, darkroom UI design, 12 built-in cinema reference looks, software code, documentation, and compilation are the exclusive intellectual property of Developer and are protected by international copyright, trademark, and trade secret laws.

4. Freemium Trial, Auto-Renewable Subscriptions & Lifetime Purchase

4.1 Complimentary 2-Photo Full-Feature Evaluation

Non-Pro users are granted up to two (2) complimentary full-feature photo exports so they may evaluate all Pro grading tools, 3-Way Color Wheels, 8-Channel Color Mix, 5-Point Tone Curves, Film Optical FX, and lossless photo formats prior to purchasing a Pro plan. Video color grading/export, 20-photo batch export, .CUBE file export, and unlimited photo exports require CineCube Studio PRO. This complimentary evaluation quota has no cash value and may be modified by Developer in future updates.

4.2 CineCube Studio PRO Plans

CineCube offers three Pro upgrade options via the Apple App Store (exact localized pricing is displayed in your local currency on the in-app Paywall prior to purchase):

  1. Annual Studio Pass: Auto-renewable annual subscription.
  2. Weekly Creator Pass: Auto-renewable weekly subscription.
  3. Lifetime Ownership: Single one-time, non-consumable purchase.

4.3 Billing, Auto-Renewal & Cancellation Terms (App Store Guideline 3.1.2)

  • Payment: Payment is charged to your Apple ID account by Apple at confirmation of purchase.
  • Automatic Renewal: Auto-renewable subscriptions (Annual Studio Pass and Weekly Creator Pass) automatically renew for the same duration and price unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Renewal Charge Window: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
  • Forfeiture of Unused Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Lifetime Ownership Scope: "Lifetime Ownership" grants access to CineCube Studio PRO features for the commercial lifetime of the CineCube application on the Apple App Store across devices signed into the purchasing Apple ID, without recurring subscription fees.
  • How to Manage or Cancel: You can manage your subscriptions and turn off auto-renewal at any time after purchase by going to iOS Settings → [Your Name / Apple ID] → Subscriptions (or visiting apps.apple.com/account/subscriptions). Uninstalling or deleting the CineCube app from your device does NOT automatically cancel an active Apple ID subscription.
  • Refunds & Billing Disputes: Because all transactions are processed exclusively by Apple Inc., Developer cannot access your payment method or issue direct monetary refunds. All refund requests must be submitted directly to Apple Support at reportaproblem.apple.com in accordance with Apple Media Services Terms.

5. Production, Color-Accuracy & Data Backup Disclaimers

5.1 Mandatory Backup of Original Camera Footage & Photos

Color grading, multi-photo batch rendering, 4K/ProRes video transcoding, and .CUBE LUT generation are hardware-intensive operations that depend on available device storage, thermal headroom, and system resources:

  • YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING INDEPENDENT, VERIFIED BACKUPS OF ALL ORIGINAL PHOTOS, RAW CAMERA FOOTAGE, VIDEO CLIPS, AND .CUBE FILES BEFORE IMPORTING, GRADING, OR EXPORTING WITH CINECUBE.
  • Developer shall have zero liability for any lost, overwritten, truncated, or corrupted photos, video files, audio tracks, metadata, or .CUBE files, or for any missed commercial shoot deadlines, client rejections, or re-shoot expenses.

5.2 Display Calibration & Third-Party NLE Color Pipeline Differences

Perceptual color appearance depends on display hardware (OLED True Tone, Night Shift, P3 Display vs. sRGB, HDR headroom), camera exposure, and how third-party NLEs (such as DaVinci Resolve, Premiere Pro, Final Cut Pro, or CapCut) configure their color management settings, gamma tags, LUT interpolation, and video luminance ranges. Developer does not warrant that a .CUBE LUT or video export will render identically across every third-party display, broadcast monitor, or desktop editing timeline without user verification.

6. Disclaimer of Warranties ("AS IS" & "AS AVAILABLE")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CINECUBE AND ALL GENERATED .CUBE LUTS, PRESETS, COLOR TRANSFERS, AND EXPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND—WHETHER EXPRESS, IMPLIED, OR STATUTORY—INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, BROADCAST OR DCI COMPLIANCE, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF MEMORY OR RENDERING TERMINATIONS ON ALL RESOLUTIONS, OR COMPATIBLE WITH EVERY FUTURE VERSION OF iOS, iPadOS, macOS, OR THIRD-PARTY SOFTWARE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY DEVELOPER SHALL CREATE A WARRANTY.

7. Limitation of Liability & Maximum Liability Cap

TO THE FULLEST EXTENT NOT PROHIBITED BY APPLICABLE LAW:

  1. No Consequential or Indirect Damages: IN NO EVENT SHALL DEVELOPER BE LIABLE FOR ANY PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF CLIENT REVENUE, CORRUPTION OR LOSS OF PHOTOS, VIDEOS, OR DATA, FAILURE TO TRANSMIT OR EXPORT ANY MEDIA, PRODUCTION DELAYS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE CINECUBE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  2. Aggregate Liability Cap: IN NO EVENT SHALL DEVELOPER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE GREATER OF:
    • (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR CINECUBE VIA THE APPLE APP STORE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
    • (B) TEN UNITED STATES DOLLARS ($10.00 USD).

THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES OR THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY SUCH STATUTES.

8. User Indemnification (Hold Harmless)

You agree to defend, indemnify, and hold harmless the Developer (Majid AlJishi), and his affiliates, licensors, and service providers, from and against any and all third-party claims, demands, lawsuits, regulatory actions, liabilities, damages, judgments, awards, losses, costs, expenses, and reasonable attorneys' fees arising out of or relating to:

  1. Your violation of these Terms or any applicable law or regulation;
  2. Any Reference Image, Target Photo, Target Video, audio track, or .CUBE LUT that you import, create, export, publish, or distribute using CineCube (including any claim of copyright infringement, trademark dilution, right of publicity/likeness violation, defamation, or privacy violation);
  3. Any commercial dispute between you and your photography, filmmaking, or social media clients regarding deliverables graded with CineCube.

9. Apple Inc. Mandatory Third-Party Beneficiary Provisions

In accordance with Apple's App Store Minimum Terms of Developer's End-User License Agreement (Schedule 1 / Schedule 2 of the Apple Developer Program License Agreement), you and Developer acknowledge and agree that:

  1. Acknowledgement: These Terms are concluded between you and Developer only, and not with Apple Inc. ("Apple"). Developer, not Apple, is solely responsible for the Licensed Application ("CineCube") and the content thereof.
  2. Maintenance and Support: Developer is solely responsible for providing any maintenance and support services with respect to CineCube, as specified in these Terms, or as required under applicable law. You and Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to CineCube.
  3. Warranty: Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in Section 6. In the event of any failure of CineCube to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for CineCube to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to CineCube, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Developer's sole responsibility.
  4. Product Claims: You and Developer acknowledge that Developer, not Apple, is responsible for addressing any claims of yours or any third party relating to CineCube or your possession and/or use of CineCube, including, but not limited to: (i) product liability claims; (ii) any claim that CineCube fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  5. Intellectual Property Rights: You and Developer acknowledge that, in the event of any third-party claim that CineCube or your possession and use of CineCube infringes that third party's intellectual property rights, Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim to the extent required by these Terms.
  6. Third-Party Beneficiary: You and Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

10. Export Control & Sanctions Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties (including the U.S. Treasury Department's List of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's List or Entity List).

11. Governing Law, Dispute Resolution & Severability

  • Governing Law: Except to the extent preempted by mandatory local consumer protection laws in your country of residence, these Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict-of-law principles.
  • Amicable Resolution First: Before initiating any formal legal proceeding, you agree to contact Developer in writing via https://majidaljishi.com/en/projects/cinecube and allow at least thirty (30) days to resolve the concern amicably.
  • Severability & Waiver: If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
